Marriage Recovery Course — Terms of Use

Please read these Terms of Use carefully before using this website. By accessing or using this website, you agree to these Terms of Use. If you do not agree, please do not use the website.

Your access to and use of this website and all related websites operated by Veritas Ministries LLC, including Marriage Recovery Course (collectively, the "Site"), is subject to these Terms of Use and all applicable laws. By accessing and browsing the Site, you accept these Terms of Use without limitation or qualification.

These Terms of Use govern your general use of the Site. They do not replace or supersede the Coaching Agreement or the Course Content Agreement, each of which separately governs its own subject. If a term here appears to conflict with either of those agreements, the Coaching Agreement governs the coaching relationship, the Course Content Agreement governs the Products, and these Terms of Use govern general use of the Site.

  1. Ownership and License.  The Site and all content, videos, training materials, products, services, and other materials made available on the Site by us or third parties, together with the look and feel of the foregoing (collectively, the "Content"), are maintained for your personal use by Veritas Ministries LLC (the "Company") and are the property of the Company and/or its third-party providers. Content includes all proprietary videos, HTML/CSS, JavaScript, graphics, voice and sound recordings, artwork, photos, documents, and text, excluding only materials you provide. Subject to your compliance with these Terms of Use, the Company grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access, view, and use the Site for your personal purposes. No Content may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, used for public or commercial purposes, or downloaded in any way without the Company's express written permission. Modifying the Content or using it for any other purpose violates the Company's copyright and other proprietary rights and may result in monetary damages and penalties.
  2. Copyright.  All Content — text, data, graphics, video, sound, and other materials — is copyrighted unless otherwise noted and is the property of the Company and/or its suppliers. No such materials may be used except as provided in these Terms of Use.
  3. Trademarks.  All trade names, trademarks, and images and biographical information of people used in the Content, including without limitation the name and mark "Marriage Recovery Course," are the property of, or used with permission by, the Company. Any unauthorized use of Content may violate the copyright, trademark, privacy, publicity, and other rights of the Company and/or third parties. Nothing in these Terms of Use grants any license or right to use any trademark or proprietary information without express written consent. The Company respects the intellectual property rights of others and may, but is not obligated to, remove content or accounts it deems unlawful, offensive, or infringing. If you believe your intellectual property rights are being violated on the Site, notify the Company at jeremy@marriagerecoverycourse.com  with your name and contact information, a description of the work and the violation, relevant registration information, the location/URL of the violation, and any other relevant information.
  4. Accuracy.  While the Company uses reasonable efforts to include accurate and current information on the Site, it makes no warranties as to accuracy and assumes no liability for any errors or omissions in the Site's content.
  5. Electronic Communications.  When you register with the Company or the Site, you consent to receive notices, announcements, agreements, disclosures, documents, and other communications from the Company electronically, including by email.
  6. Submissions.  If you send comments or suggestions about the Site to the Company — including notes, text, drawings, images, designs, or programs — those submissions become and remain the sole property of the Company, with no obligation of confidence, and the Company may use, publish, and disseminate them for any purpose without acknowledgment or compensation to you.
  7. Security.  The Company uses commercially reasonable efforts to restrict unauthorized access to its data and files. However, no system, password-protected or not, is entirely impenetrable. You acknowledge that an unauthorized third party may be able to access, view, copy, modify, or distribute data and files you store using the Site. Use of the Site is at your own risk.
  8. Privacy.  The Company will not intentionally disclose personally identifying information about you to third parties except where it believes in good faith that disclosure is necessary to comply with the law or enforce these Terms of Use. By using the Site, you accept the Company's Privacy Policy at marriagerecoverycourse.com/privacy-policy. If you do not agree with the Privacy Policy, please do not use the Site.
  9. No Guarantee of Results; "As Is."  All Content on the Site is provided "as is," without warranty of any kind, express or implied, including the implied warranties of merchantability and fitness for a particular purpose. The Company does not warrant or make representations regarding the use, results, suitability, reliability, accuracy, or correctness of the materials on the Site. The Company makes no guarantee that the Site or its Content will produce any particular outcome, including, without limitation, the survival, repair, or improvement of any marriage; outcomes depend on the individuals involved and on many factors outside the Company's control. The Company does not warrant that use of the materials will be uninterrupted or error-free, that defects will be corrected, or that the Site is free of viruses or other harmful components. The Company is not responsible for performance or service problems caused by any third-party website or service provider (for example, your internet service provider or Stripe payment services); any such problem is governed solely by your agreement with that provider. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
  10. Limitation of Liability.  To the fullest extent permitted by law, neither the Company nor any party involved in creating, producing, or maintaining the Site or its Content shall be liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to or use of the Site, including, without limitation, damage or loss of property, equipment, information, or data, or claims for service interruptions or transmission problems, regardless of the theory of liability, even if the Company has been advised of the possibility of such damages.
  11. Account and Access.  The Company may limit your use of the Site or Content, or terminate your account, if it determines you have violated these Terms of Use or any other Company rules or conditions, and may refuse access to the Site, Content, products, or services in its sole discretion. Any refund of fees is governed by the refund terms, if any, stated at the point of purchase or in the applicable purchase agreement.
  12. Indemnification.  You agree to indemnify and hold harmless the Company and its directors, officers, employees, and agents from any liabilities, claims, damages, and expenses, including reasonable attorneys' fees, arising out of or relating to (i) your breach of these Terms of Use, (ii) your violation of any law or the rights of any third party, (iii) any content you post or share on or through the Site, (iv) your use of the Site or any services provided through it, and (v) your conduct in connection with the Site, the services, or other users. The Company may assume the exclusive defense of any claim subject to indemnification, and you agree to cooperate.
  13. Benefit.  These Terms of Use are for the benefit of the Company, its subsidiaries, affiliates, and its third-party content providers and licensors, each of which may assert and enforce these provisions.
  14. Governing Law and Dispute Resolution.  These Terms of Use are governed by the laws of the State of Nebraska, without regard to conflict-of-law principles. Any controversy or claim arising out of or relating to these Terms of Use shall be settled by binding arbitration conducted by telephone or video conference before a single arbitrator mutually agreed upon by the parties, with costs shared equally. If any provision of these Terms of Use is found unlawful, void, or unenforceable, that provision is severable and does not affect the validity of the remaining provisions.
  15. Changes.  These Terms of Use may be revised from time to time by updating this posting. You are bound by any such revisions and should periodically review this page.
